February 08:

A 31-year-old man has been sent to jail for nine years by a Delhi court for trying to rape a married woman here in 2006 while his father was awarded a one-year prison term for using indecent words against the victim.

The special fast-track court, constituted to try the cases of sexual offences against women, held both Rajender Kumar, 53, and his son Ajay Kumar guilty of uttering words and making gestures to insult the victim.

The court also convicted Ajay for trying to rape the victim, outraging her modesty and causing hurt to the woman in her house at Rama Vihar here in September 2006.

The court relied on the statements of the victim and other prosecution witnesses and also on the medical records to hold the father-son duo guilty and also imposed a fine of Rs 5,000 and Rs 21,000 on Rajender and Ajay respectively.

"The prosecution has been able to bring the guilt home to the accused Rajender and Ajay beyond shadows of all reasonable doubts and there is no room for hypothesis, consistent with that of innocence of accused Rajender and Ajay," Additional Sessions Judge (ASJ) M C Gupta said.

According to the police, Rajender and his son had entered the house of the woman on September 11, 2006 and had abused her with an intention to molest her.

It said Ajay had pushed the woman aside due to which she fell down and then he tried to strangulate her, torn her clothes and had tried to rape her.
