Man to pay Rs two lakh monthly alimony to estranged wife

New Delhi, February 21:

A woman is entitled to the same standard of living as that of her husband, a Delhi court has observed while directing an oil consultant, who got married in Amritsar 14 years back, to pay Rs two lakh monthly alimony to his estranged wife. "It is a settled law that a wife is entitled to same level of living as that of husband," Metropolitan Magistrate Kiran Gupta said while directing the man, who renders consultation to mostly foreign oil exploration companies, to give Rs two lakh maintenance to his wife every month. "On the basis of evidence on record and the fact that the respondent (man) is a consultant who renders consultation to oil companies which are mostly foreign based and he is receiving the payment in foreign currency, his income can be approximately be assessed between Rs 9-10 lakh per month," the magistrate said. The court said that it was constrained to formulate an opinion pertaining to his likely income from evidence on record as he has deliberately not disclosed his income. The order came on the woman's plea seeking a monthly maintenance of Rs three lakh from her husband. The case was initially filed at Noida but was transferred to Delhi by the Supreme Court in August 2007 on the woman's plea. The couple got married in 1999 in Amritsar and the marriage was registered in Noida. They moved to Mumbai in 2004 after the man got a job with an international company dealing in the energy sector, the woman said. Accusing her husband and his family of being cruel towards her, the woman told the court that she had suffered miscarriage due to neglect and harassment.
