Akbaruddin Owaisi Attack Case: Judgment on 29th June

Hyderabad: After the completion of hearing of Akbaruddin Owaisi Attack Case, the court has fixed 29th June as the date for pronouncing judgment. Mr. Uma Maheshwar Rao, Special Public Prosecutor told that it is not appropriate to declare all the witnesses as unimportant. He informed that as per the postmortem report and the statements of the witnesses, Ibrahim bin Yonus Yafai was killed when he received only one bullet which was shot at him by gunman Jani Miyan. The Govt. pleader informed the court that the incident which took place on 30th April 2011 was not a conflict between two groups but it was a unilateral attack on Mr. Akbaruddin Owaisi. The prosecutor also told that it is not justified to defame investigating officer and it is also wrong to associate him with Gangster Nayeem. The investigating officer prepared the case and presented the witnesses in the court. He applauded the functioning of Mr. Venkatagiri, the then Inspector of Police, Chandrayangutta. He appreciated his services.

Meanwhile, heated arguments took place between Govt. pleader and the pleader of Mohammed Pahelwan. Mr. G. Gurumurthy argued in the court that Govt. pleader did not present the death case of Ibrahim Yafai as it was to be done. He declared the statements of all the witnesses as appropriate and he argued the case unilaterally.

VII Addl. Metropolitan Sessions Judge, Mr. T. Srinivas Rao announced that the judgment of this case would be pronounced on 29th June.

It may be mentioned that a case was registered by Chandrayangutta Police in connection with the incident which took place on 30th April 2011 attacking Mr. Akbaruddin Owaisi, MIM MLA. Chandrayangutta Police registered a case under the sections 147, 148, 324, 307, 120(B) of IPC and Indians Arms Act against Mohammed bin Omer Yafai alias Mohammed Pahelwan and his relatives Hasan bin Omer Yafai, Yonus bin Omer Yafai, Mohammed bin Salim Dahlan, Esa bin Yonus Yafai, Yahya bin Yonus Yafai, Abdullah bin Yonus Yafai, Awad bin Yonus Yafai, Atif Yafai, Saif, Faisal bin Ahmed, Fazal bin Ahmed, Bahadur Ali Khan alias Munawar Iqbal whereas accused number 4 Ibrahim bin Yonus Yafai was killed with the bullet fired by gunman Jani Miyan.

The investigation of this case was entrusted to CCS which filed chargesheet against all the accused persons. Govt. appointed Mr. Uma Maheshwar Rao, Advocate as Special Public Prosecutor. There are 83 witnesses in this case including Mr. Akbaruddin Owaisi, Ahmed bin Balala (MLAs) and other Corporators and MIM workers.

Under the instructions from the Supreme Court to complete the hearing by trial court within 6 months, the judge continued hearing on daily basis. The accused persons used to be presented daily in the court bringing them from Cherlapally Jail.
