High Courts: Minors can choose not to live with the parents

High Court: A bench of Justices Vipin Sanghi and Deepa Sharma had denied the custody of a minor girl to her parents, during the hearing of a man’s habeas corpus plea for tracing his missing daughter.

As according to the fifteen old year girl, she was safe at the shelter home and did not want to return to her parents. The girl told the Child Welfare Committee. She was traced in Mathura and refused to go back to live with her parents, a report of the Quint says.

The reports by Delhi police said that she had eloped with a 32-year-old man in July 2016, who would work near her place.

The girl had married this man and was living in a house, where the man would visit once in a week to provide groceries and money, She threatened him to commit suicide if he did not return, the senior standing of the counsel Rahul Verma and advocate Tushar Sannu informed.

After her statement given in the court on April 25, an FIR was lodged against the man with whom she ran away. She was then taken to a shelter, when she refused to return to her parents.
