Fundamental Prohibitions: Health Protective Measures

Sexual misdemeanours

Sex is the water of life. It sustains the human existence and brings colour to the life. But sex also brings huge responsibilities with it. The case of human beings is different from animals. In animals all the responsibilities related to sex fall on the shoulders of females; males do absolutely nothing but impregnate females. They have nothing else to shoulder — during pregnancy, at the time of delivery and during the growth of children. God has been extremely kind to women; in every part of their biological functions, they have been assured of men’s support. Ensuring male cooperation in an effective way necessitates family system, which does not only relieve women of the burden of looking after children alone but also provides children with a highly congenial atmosphere for growth. Furthermore, it protects women from unwanted intrusions into their modesty, exploitation and abuse, safeguards children against abuse and devastation in life and bestows upon men a life of comfort and peace. Family system also acts as an infallible barrier between human beings and life-threatening viruses, bacteria and protozoans, ensuring longevity and better quality of life. If Sex within marriage is a guarantee to health and security, sex outside marriage is an invitation to diseases, destruction and devastation. While Islam promotes sex between a man and a woman, within the boundaries of marriage, it prohibits sex outside marriage; all forms of extramarital relationships are not only sins in the eyes of God but also punishable crimes under Islamic legal system. Apart from extramarital relationships, Islam also prohibits homosexuality, anal sex with women, prostitution and any erotic depiction of human body. Qur’an says:

Sex outside marriage
· Moreover, do not ever come close to sex outside marriage; it is undoubtedly an illicit and obnoxious practice. 17: 32)

Homosexuality

· Moreover, if any two men among you behave illicitly, punish them both! If then they pledge never to repeat the act, and reform themselves, leave them. Certainly God is Kind-to-repentance-Merciful. (4: 16)

Forced marriage and Prostitution

· People Committed (to System)! It is not approved for you to take hold of women through compulsion (against their will). (4: 19)

· Moreover, do not force girls under your (protection) to prostitution, despite their desire of decency, with the aim of acquiring some worldly benefits. And in case any ones have been forced into it, God is surely Forgiving-Merciful to such victimised women. (24: 33)

The problems related to prohibited sexual practices have assumed such enormous proportions that sex can now be regarded as the biggest tormentor of human life. It has been killing millions of men, women and children, exterminating family system, desecrating the sanctity of women, denigrating them into prostitutes and porn actors, transforming them into single mothers, divorcees and unwed mothers; and killing foetuses, converting children into half-orphans and making them vulnerable to all sorts of abuses.

Sexually transmitted diseases (STD), also referred to as sexually transmitted infections (STI) and venereal diseases (VD), are illnesses that have a significant probability of transmission between humans by means of sexual behaviour, including vaginal intercourse, anal sex and oral sex. Obviously, sex with multiple partners is mainly responsible for the spread of the STDs; and the chances are typically extremely low in sex partners having long term loyalty with each other. Some STIs can also be contracted by using IV drug needles after their use by an infected person, as well as through any incident involving the contact of a wound with contaminated blood or through childbirth or breastfeeding.

There are a number of infections associated with various sexual behaviours6: These include Throat Chlamydia, Throat gonorrhoea , Herpes , HPV, Syphilis, Crabs, Scabies, Gonorrhoea, Hepatitis B, HIV, Trichomoniasis, Giardiasis, Hepatitis A and Shigellosis.

The issues related to HIV/AIDS and the total global burden of diseases related to sexual misdemeanours including homosexuality will be discussed later.

The biggest killer in terms of loss of human lives related to the modern sex and sexuality is the absolute right to abortion including the conditions where the continuation of pregnancy has no medical issue associated with it. Choice of abortion, like many other rights given to women such as right to bare her body, right to work as sexual workers and right to have sex with anyone, is meant to benefit and has benefited men more than women. This freedom given in the name of “freedom of choice” to women kills more than 50 million human foetuses globally ever year. This huge loss of life is lamented neither by the human rights activists nor the other international institutions patronised or influenced by the forces of economics. This issue will also be discussed later. The same is the case of loss of lives due to suicides related to sexual abuses, broken relationships and crimes.

Psychiatric disorders related to unhealthy sexual practices and extramarital lesions include Nervousness, Anxiety, Depression and Suicidal tendencies. The detection of HIV in blood has led to many a suicide in the last two decades. There have also been a number of reports regarding HIV positive persons going on the infecting spree as part of revenge or frustration.

It will suffice here to say that as far as the impact on the human life and its well being is concerned, the modern sexuality with freedom of sex without marriage and to engage in sexual perversions like Homosexuality has been nothing less than disastrous.

Forbidden degrees in marriage

Qur’an says:

Unbelieving women

· Do not marry with the women with pantheistic beliefs until they commit themselves (to God). A slave woman who is committed (to God) is better than a woman with pantheistic beliefs, even though she may charm you. And do not marry to men with pantheistic beliefs until they commit themselves (to God). A slave man who is committed (to God) is better than a man with pantheistic beliefs, even though he may attract you. They invite you to the Fire; and God invites you to the Garden (of Paradise) and Amnesty through His Signal; and clarifies His wondrous messages to the human beings; so that they keep admiring Him. (2: 221)

Already married women

· (Prohibited for you) also are women already married with the exception of women who are your slaves. (4: 24)

Wives of fathers

· Moreover, do not marry the women your fathers ever married, except what has already happened in the past; it was shameful and foul — truly an obnoxious practice. (4: 22)

Near Relatives

· Prohibited to you (for marriage) are: your mothers, daughters, sisters; father’s sisters, mother’s sisters; brother’s daughters, sister’s daughters; foster-mothers (who breastfed you), foster-sisters; your wives’ mothers; your step-daughters under your guardianship, born of your wives with whom you have already had intercourse,- there is no prohibition though if you have not yet had intercourse;- the wives of your biological sons ; and two sisters simultaneously in marriage, except for what has already happened in the past…(4: 23)

Islam prohibits marriages between immediate relatives – between brothers and sisters, uncles and nieces and aunts and nephews. This automatically decreases the chances of incest, sexual abuse and rapes of women and children by close relatives. This strengthens a healthy family life; and young children and girls can grow in an atmosphere of harmony and security. Furthermore, it is a well-known fact that the dangers of congenital abnormalities increase with the closeness of spouses. Consanguineous marriages are permitted in Islam but not promoted; it is better to avoid marriages in very close relations.
