Division Bench of Hyderabad High Court asked Maulana Syed Shah Akber Nizamuddin Husaini to file the counter affidavit to Waqf Board. Division bench comprising of acting Chief Justice Dilip D Bhoslay and Justice P Naveen Rao pronounced the verdict during the hearing of the case.
Waqf Board had issued show cause notice on June 29, 2015 asking the mutavalli why he should not be suspended from the post.
It must be noted that Mutavallis of Dargah Hazrat Shah Khamosh Nampally and Dargah Hazrat Peeran Husaini have already been suspended from their posts. Waqf Board had enclosed investigative report along with show cause notice and had asked to file counter affidavit within 15 days. Instead of replying to Waqf Board the petitioner moved to High Court. On the direction of High Court counter affidavit was submitted to Waqf Board.
