Appointment of Wakf Board’s incharge CEO challenged in Hyderabad HC

Hyderabad: High Court of Hyderabad admitted a petition challenging the appointment of incharge CEO of TS Wakf Board. The next hearing of the case has been scheduled for 8th November. Justice A Rajsekhar Reddy gave two weeks’ time to file an affidavit by TS Govt.

In the petition, challenging the appointment of Mr. Shahnawaz Qasim as incharge CEO of Wakf Board, it has been pointed out that the provisions of the Wakf Act have been violated. It was stated that as per section 23 (14), the appointment of CEO of Wakf Board should be permanent not temporary. In the Wakf Act, there is no provision for the appointment of incharge CEO. Govt. should finalize a panel of three officials and select one from it. CEO should be from Revenue or Law Dept. He should be of the cadre of Dy. Secretary or above.

In the petition, it was mentioned that Mr. Shahanawaz Qasim was made incharge CEO when the CEO went on leave. Later, Wakf Board confirmed his appointment. He is holding this post as incharge till now. The advocate also pointed out certain lacunae in his appointment on which Govt. pleader informed that Govt. cannot make any appointment since Election Code of Conduct is in vogue. He also said that if the appointment of present incharge CEO is set aside, the functioning of Wakf Board would get affected.

After hearing the arguments of both the parties, the judge fixed the date of next hearing on 8th November and ordered the Govt. to file an affidavit within two weeks.
