Court asks Jammu and Kashmir police to register FIR against DySP

A city court has directed the SSP Srinagar to register an FIR against a Deputy Superintendent of Police “within 24 hours” in connection with the killing of a youth in Tengpora area of the city on July 10.

“The SSP Srinagar is directed to lodge FIR and comply with the directions of this court dated July 18, 2016 and file the copy of FIR within 24 hours,” Chief Judicial Magistrate (CJM), Srinagar, Masrat Shaheen said in her order yesterday. Otherwise, the CJM said, SSP Srinagar will have to personally appear in court “to show cause as to why action shall not be taken against him”.

The CJM on July 18 had directed SSP Srinagar to file an FIR against DySP Yasir Qadri and other police personnel on an application filed by father of Shabir Ahmad Mir, who was allegedly killed inside his house at Tengpora in Batamaloo area on July 10. The counsel of the complainant pleaded before the court that despite directions, SSP Srinagar has not lodged an FIR.

He had filed an application for initiating contempt proceedings against SSP Srinagar Amit Kumar. The Chief Prosecuting Officer pleaded before the court that an FIR has already been registered in connection with the incident and investigation has been handed over to SP North City Sajad Khaliq. “The facts of FIR number 89/2016 is different and thus the present FIR will not be FIR for the occurrence … police has claimed that it was deceased and other accused persons in the present FIR who have committed offence under sections 147,148,152,307,336,436 RPC,” the court said. “But on the other hand, the present application reveals that the police officer has exceeded his powers in the house of complainant and has shot dead the son of the complainant and thereby has committed a cognizable offence like murder,” it said.
