Draft law against Triple Talaq includes 3 yr sentence for guilty husbands

New Delhi: After Supreme Court declaring instant triple talaq illegal three months ago, the government’s draft law to penalise husbands, who would found guilty, with three years in prison.

The new law to be laid in the Winter session of Parliament and likely to be termed as The Muslim Women (Protection) Rights on Marriage Act, 2017, reported CNN-News18.

The law would make triple talaq a non-bailable offence and has provisions for monetary fine along with jail term of three years. Additionally, the draft law to also have provisions for compensation to women.

Once the law is enforced, women can directly take help of police without a need for Muslim clergy.

As of now, police can only employ sections under IPC for action as no specific act can be invoked against the husband in the absence of punitive provisions in the law dealing with triple talaq.
