Hadiya’s case: Will NIA probe Muslim BJP leaders who have Hindu wives, asks lawyer

New Delhi: A senior advocate appearing for Shafin Jahan’s ‘love jihad’ case on Tuesday asked the Supreme Court if NIA will probe two Muslim BJP leaders, who have Hindu wives.

The case quite for some time is making headlines as the court is trying to find out whether the 25-year-old Hindu girl Akhila (now Hadiya), converted to Islam and married Muslim youth Shafin Jahan, was trapped by a “well-oiled racket that uses psychological measures to indoctrinate people and persuade them to join terrorist organisations such as ISIS”.

These allegations were made by Hadiya’s father and were endorsed by Kerala High court. Hadiya’s husband Shafin Jahan then moved to SC with the help of his lawyer Haris Beeran and challenged the HC order that voided his marriage on plea of Hadiya’s father.

As per a report by India Today, Dushyant Dave, senior advocate for Jahan urged the bench headed by Chief Justice Dipak Misra to withdraw the order of NIA probe, and said it “struck at the very foundation of a multi-religious society and sent wrong signal world over”.

The senior advocate, without referring to any name, asked the court: “two top BJP Muslim functionaries have married Hindu women. Can it be called a love jihad and will your lordship order an investigation?” While doing so, he had raised his pitch, CJI Misra then asked Dave to stick to facts, argue on law, based on logic and requested him not to raise his voice.

Dave did not take any party leaders’ name, but he apparently pointed to Mukhtar Abbas Naqvi and Shahnawaz Hussain, mentions India Today.

Dave told the court, as per the fresh evidence after the order, the girl had converted of her own free will and she is being confined and tortured by her parents.
