Kolkata: Withdrawing the charges levelled against cricketer Mohammad Shami may not be possible for his wife, Hasin Jahan, lawyers said on Wednesday. The accusations she has made against him contain some bailable and one non-bailable charge, including that of domestic violence, adultery, physical and mental torture, rape, attempt to murder by means of poisoning. Whereas, Shami has reportedly tried to settle the differences with his wife and persuaded her to bury all the matters.
According to a report by Hindustan Times, Jahan’s counsel Zakir Hussain said that she will record a confidential statement in the court of the additional chief judicial magistrate in Alipore on March 19. While, a criminal lawyer, Kaushik Gupta of Kolkata High Court said: “It is a well-thought-out strategy for the police to arrange for her confidential statement. If she goes back on her words later, it will be considered as perjury, where the offender can be prosecuted under Section 191 of the IPC (Indian Penal Code).” Punishment for this offence may lead up to seven years along with penalty, he added.

Anirban Guha Thakurta, another criminal lawyer said that Jahan can be charged with section 211 if she takes back the complaint. Jahan, on the other hand, said that she stands what she had alleged. “I am not going back on my complaint. I have entered this battle filed and I shall fight to the finish,” she said on Tuesday.
As far as the cricketer is himself concerned, he has maintained that he is being framed and this whole controversy is a conspiracy against him. Meanwhile, cricketers like MS Dhoni and Kapil Dev backed Shami saying ‘he can’t cheat his wife or his country’. “As far as I know, Shami is a great human being. He cannot cheat his wife and country. This is Shami’s personal matter and we should not make any comment on it,” Dhoni had said.
