Hyd HC sets aside single judge order on YSRC MLA Roja’s

A division bench of the Hyderabad High Court today set aside the single judge’s order staying the suspension of YSR Congress MLA R K Roja from Andhra Pradesh Assembly for a year for allegedly using unparliamentary language in the House.

Roja had been suspended from attending the proceedings of the Assembly for one year during the winter session of the Assembly in December last year for her alleged “derogatory” remarks against Chief Minister N Chandrababu Naidu.

A division bench, headed by acting Chief Justice Dilip Bhosale, allowed the appeal filed by Andhra Pradesh government against the single judge’s order.

The single judge had concluded that the Speaker has no power to suspend any member of House beyond the remainder of session under the Assembly business rule no. 340.

The government filed an appeal against the single judge’s order stating that the HC has no power to interfere in the conduct of the business of House by the Speaker.

The bench today upheld the contention of government.
