Wakf to reclaim 50 crore after 60 yrs

After almost 60 years, the State Wakf Board would be reclaiming the Macca Madina building and its attached properties at Pathergatti by initiating civil and criminal action against encroachers, who have collected and continue to collect huge rents in the name of ‘Wakf’.

As per the recently issued proceedings by TS Wakf Board, it was held that Habeeb Alladin, the ‘self-styled’ managing trustee created four wings over the past several years known as Alladin Charities & Zakat Wakf, Alladin Charities Wakf, Alladin Education Endowments Wakf, Alladdin Muslim Charitable Wakf out of the main Wakf institution, the Macca Madina Wakf. It pointed out that the managing trustees had never submitted the mandatory budget statements showing the income and expenditure, since its date of inception in 1954.

While referring to the Firman of Nizam dated 1944, which was issued with the opinion of the then council, the Wakf Board has challenged the claim of the current trust, which claimed to be managing the historic building. It pointed out that the Firman clearly mentioned the criteria of construction of building by Ahmed Nawaz Jung (who bought the land at concessional price of Rs 1.87 lakh) would be made wakf for the deserved people of Madina (Saudi Arabia).

To achieve this objective, the Ahmed Nawaz Jung executed a Wakf Nama (Wakf Deed) on September 17, 1948 and constructed the Macca Madina Wakf building on the said purchased land. The four storey building comprises of 21stalls, 24 flats in an area of 2,600 sq yards and the remaining area was left vacant.

The Muthawalli Ahmed Nawaz Jung died in 1954, but no substitute was appointed to the office of Muthawalli in his place. The Wakf Board has claimed that the position remained vacant even till this date. “Since the Wakf Nama does not mention the procedure of succession, no Muthawalli or other committee members were appointed by the Wakf Board nor any claim has been made from any of the members to the Wakf Board,” says Md Asadullah, CEO, TS Wakf Board.

This deviation was in contravention of the objective of the Wakf and without any legal provision or sanction of the Wakf Board. The Board also found him guilty of supervising managing committees for each of these newly created institutions without the approval of the Wakf Board.

It also pointed out that the managing trustees had never submitted the mandatory budget statements showing the income and expenditure, since its date of inception in 1954. “There is no provision in the Wakf Act to create new Wakfs out of an existing notified Wakf.

Hence criminal action would be initiated against him under the provisions of Wakf Act, 1995, IPC and under the provisions made to deal with financial crimes committed by him by misappropriating the income of the Wakf Institutions,” said the CEO. When The Hans India sought clarification from Habeeb Alladin, the ‘self-styled’ managing trustee, he refused to speak on the subject saying, “I do not want to speak on this subject.”
