Gurugram: The Haryana Real Estate Regulatory Authority (HRERA) on Monday issued a final notice to real estate developer Supertech Ltd for allegedly cheating customers for a non-existent residential project, an official said.
The HRERA official said it was a peculiar case wherein neither the project nor any plan was approved but still dwellings units were allegedly sold by the developer.
The notice was issued on a complaint filed by Sanjay Yadav of Sector 46 here against Supertech Limited, which has its office in Gurugram’s Sector 68.
“The builder issued an advertisement in newspapers on January 16, 2016 to invite applications for a new project “Officer Enclave”, which offered high-rise independent floors in Sector 2 on the Sohna Road, even though the property did not exist,” the official said.
The complainant had booked a flat on February 5, 2016 and deposited Rs 10,26,033 and another Rs 17,175 as service charges with Messrs Investors Clinic for a dwelling unit.
In June last year, a representative of the builder told the complainant that the project wherein the complainant had booked the unit was not going to be implemented and asked him to opt for any other company project.
The complainant’s counsel said his client is not appearing before HRERA for compensation but for fulfilment of the promoter’s obligation under the Real Estate (Regulation and Development) Act, 2016.
“It seems that to cheat the complainant as well as other buyers, they have sold/booked a large number of flats,” the official added.
“Accordingly, the matter needs to be investigated in detail and, if needed, a criminal case ought to be filed under the Indian Penal Code for cheating the allottees. This course of action shall be in addition to any other penal/criminal action warranted under the RERA Act,” authority Chairman K.K. Khandelwal told IANS.
“The authority took suo motu cognizance of the fraud and mischief committed against a large number of buyers and appointed HRERA’s Executive Secretary Varinder Choudhary to investigate. He will submit a report within 30 days,” Khandelwal added.
