‘Instant Triple Talaq’ now a criminal offense, Union Cabinet approves Bill

New Delhi: The Union Cabinet today has approved the Muslim Women (Protection of Rights on Marriage) Bill also known as Triple Talaq Bill as a criminal offense.

The central government had previously constituted a committee to draft a law that would make instant- Triple Talaq practice an offense.

The drafted bill proposes three-year of jail term for men practising the instant “triple talaq” along with making it a cognizable offense and a non-bailable offense.

Various states like Assam, Jharkhand, Madhya Pradesh, Maharashtra, Manipur, Uttar Pradesh and Uttarakhand have agreed to the proposed bill.

After the controversial instant-Triple Talaq invited criticism from various Muslim women seeking Supreme Court’s intervention against the practice used so unlawfully in India which Islam has never given a nod to.

The Supreme Court made the instant Triple Talaq or ‘talaq- e-biddat’ as arbitrary and unconstitutional in August.

Citing Instant Triple Talaq as against the teaching of Islam, the apex court has struck down the unlawful practice.

A five-Judge constitution bench, in its 395-page order, had said: “In view of the different opinions recorded by a majority of 3:2, the practice of ‘talaq-e-biddat’ – triple talaq is set aside,” Times Now reported.
